This electronic document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020 that require publishing the rules and regulations, privacy policy, and terms of use for access or usage of the website https://www.nariniketan.shop (and nariniketan.shop).

The platform is owned and operated by Nari Niketan, having its principal place of business located at Rihand Nagar, District Sonbhadra, Uttar Pradesh – 231223, India.

In accordance with the Indian Contract Act, 1872 (Section 11):

• Age Requirement: You must be at least 18 years of age and legally competent to enter into a binding contract. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 are not eligible to transact directly on the platform.
• Minors: If you are a minor (under 18 years), you may transact only through your legal parent or guardian who registers and undertakes the contract on your behalf.
• Account Integrity: You are responsible for maintaining the confidentiality of your login credentials, password, and OTPs. You agree to accept responsibility for all transactions occurring under your authenticated account.
• Accurate Details: You agree to provide true, current, and complete delivery and identity details. Nari Niketan reserves the right to suspend or terminate accounts providing inaccurate or fictitious information.

Under Section 10A of the Information Technology Act, 2000, contracts formed through electronic means, electronic records, and digital communications are legally valid and enforceable in courts across India:

• When you browse products, add items to your cart, and place an order, you make an electronic offer to purchase the selected merchandise.
• Our automated order confirmation (displayed on screen, generated via invoice receipt, or dispatched via SMS/Email) constitutes electronic acknowledgment of your order.
• You consent to receive order updates, delivery dispatch tracking, invoices, and policy updates electronically via SMS, WhatsApp, Email, or website notifications.

Pricing Transparency & GST Compliance

In compliance with the Consumer Protection (E-Commerce) Rules, 2020 and the Legal Metrology (Packaged Commodities) Rules, 2011:

• Dual-Pricing Display: Products clearly display the Maximum Retail Price (MRP) and the discounted Selling Price (Sale Price) in Indian Rupees (INR ₹).
• All-Inclusive Prices: Prices stated on the platform are inclusive of all applicable Goods and Services Tax (GST) as mandated by the CGST/SGST Acts.
• Handcrafted / Artisanal Textiles: Our apparel (Sarees, Suits, Lehengas, Kurtas) involves authentic Indian weaves, handlooms, zardozi, and embroidery. Subtle variations in texture, color tones due to studio lighting, thread slubs, and hand-block printing nuances are inherent characteristics of artisanal craftsmanship and are not considered defects.
• Pricing Errors: In the rare event of an inadvertent technical typographical error in pricing or product stock, we reserve the right to decline or cancel the affected order and issue an immediate 100% full refund.

We provide secure, convenient payment options for shoppers across India:

• Delivery Timelines: Standard order deliveries typically take between 3 to 7 business days across India, depending on customer PIN code accessibility and logistics network conditions.
• Logistics Partners: Parcels are shipped through leading national logistics carriers (e.g. Delhivery, BlueDart, Shiprocket, India Post).
• Tracking: Once dispatched, a live tracking link is provided in the My Orders section and sent via SMS/Email.
• Inspection on Delivery: Customers are advised to inspect external parcel packaging for severe physical tampering before accepting delivery.

In accordance with our Return & Refund Policy and the Consumer Protection (E-Commerce) Rules, 2020:

• 7-Day Return Window: You may request a return within 7 days from the date of delivery for eligible items.
• Eligibility Criteria: Products must be unused, unwashed, with all original tags, packaging, and invoices intact.
• Free Reverse Pickup: Reverse courier pickup is scheduled directly from the original delivery address at no extra cost.
• Refund Processing: Approved refunds are credited within 5 to 7 business days to the original payment source (or via secure NEFT/UPI for COD orders).

All content hosted on this platform, including but not limited to the brand name "Nari Niketan", logos, brand trademarks, website user interface design, graphic icons, digital illustrations, product photographs, styling designs, and software source code, is the exclusive intellectual property of Nari Niketan and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999 of India.

No user or third party may copy, reproduce, scrape, modify, distribute, or create derivative works without prior written authorization from Nari Niketan.

Under Rule 3(1)(b) of the Information Technology Rules, 2021, users are strictly prohibited from hosting, displaying, uploading, modifying, transmitting, or sharing any information that:

• Belongs to another person and to which the user does not have any legal right;
• Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, or racially/ethnically objectionable;
• Infringes any patent, trademark, copyright, or proprietary rights;
• Deceives or misleads the addressee about the origin of the message or contains software viruses, malware, or destructive code;
• Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order.

For independent vendors, artisans, and sellers registered on our Seller Portal:

• Authenticity & Quality: Sellers warrant that all ethnic products uploaded are 100% genuine, new, and compliant with Indian Legal Metrology and BIS quality standards. Counterfeiting is strictly prohibited.
• Order Dispatch SLA: Sellers must pack and dispatch assigned orders within the prescribed fulfillment timeline (typically 24–48 hours).
• Independent Accountability: Sellers must honor return requests approved under the platform's return policy.

• Service Availability: While we strive for 99.99% uptime, we do not guarantee uninterrupted or error-free access during scheduled server maintenance or force majeure events.
• Cap on Liability: To the maximum extent permitted under applicable Indian laws, the total aggregate liability of Nari Niketan for any claim arising out of your purchase shall be limited to the actual amount paid by you for the specific product order in dispute.
• Force Majeure: Nari Niketan shall not be held liable for failure or delay in delivery resulting from events beyond reasonable control, including natural disasters, governmental restrictions, severe weather, strikes, or transport disruptions.

These Terms & Conditions shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India.

Any dispute, controversy, or claim arising out of or relating to these terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts in Sonbhadra, Uttar Pradesh, India.
